"So in summary, several things are happening at once during 'Vitamin O' production: Normal electrical flow is reconfigured before going into the saline solution; the salt water itself is given repeated buzzings; and the timing sequence is very carefully calibrated to produce the 'heavy' or super-enriched oxygen water." According to attorney Jonathan Emord, "Under the FTC's fickle 'competent and reliable scientific evidence' standard, any ad called into question can be proven deceptive because the agency redefines the standard in every case. Essentially, absent conclusive proof (something virtually impossible to achieve in science), you can never know whether anything you say about a dietary supplement will get you in trouble with the FTC." Let's look at the events surrounding the Vitamin O product. In March 1999, the FTC filed a compliant against Rose Creek Health Products alleging deceptive advertising. In May 2000, the owner of the company settled the compliant, not wanting to go through an expensive court case.
